PETITION FOR NATIONAL FORECLOSURE TRANSPARENCY AND OVERSIGHT PLATFORM (FTOP)
TO: United States Congress, United States Senate, United States Department of Housing and Urban Development (HUD), and the White House
We, the undersigned citizens of the United States, hereby petition our federal government to immediately establish a Foreclosure Transparency and Oversight Platform (FTOP)—a federally mandated, nationwide system that ensures due process, accountability, and uniform legal standards in all foreclosure proceedings, whether judicial or nonjudicial.
I. PURPOSE OF FTOP
The FTOP will serve as a centralized, publicly accessible digital platform where mortgage servicers, banks, trustees, and foreclosure attorneys must log every step of the foreclosure process. This includes:
Recording the Notice of Default (NOD) with time stamped proof
Proof of certified mailing of foreclosure documents
Proof of personal service or posting on the property
Notices of trustee sale or court filings
Three documented attempts at borrower contact, per law
Loan modification or foreclosure alternative offers
HUD counseling disclosure and referral
Status of state or federal mortgage assistance funds received
Contact information and real-time status updates accessible by the borrower
II. WHY FTOP IS NECESSARY
1. Widespread Abuse in Nonjudicial States:
In states like California, Arizona, and Nevada, homeowners are routinely foreclosed upon without ever seeing a courtroom.
Banks file fraudulent documents with no oversight, and homeowners bear the burden of initiating court action to defend their rights.
2. No Consistency Across States:
Judicial states provide court hearings and due process.
Nonjudicial states allow private trustees and banks to act as judge, jury, and executioner, often without verification or notice.
3. Due Process Violations:
Millions of homeowners have had their properties seized through fraudulent filings, forged signatures, mail fraud, and unlawful service.
Many were never contacted, despite banks swearing under penalty of perjury that they were.
4. Federal and State Laws Are Routinely Ignored:
California’s Homeowner Bill of Rights (HBOR) is ignored due to lack of oversight. Federal programs like the Homeowner Assistance Fund (HAF) are bypassed or falsely claimed as used.
5. No Uniform Oversight Exists:
The CFPB lacks centralized enforcement power. The OCC, FDIC, and other agencies rely on complaints, which often go uninvestigated.
6. Banks Operate Across State Lines—So Should Oversight:
The same banks that foreclose in Ohio also operate in California, yet they follow entirely different procedures based on state.
Commerce Clause powers give Congress the authority to implement a unified system.
III. HOW FTOP WILL WORK
Mandatory Participation by All Mortgage Servicers and Trustees
Secure Login for Homeowners to track each legal step
Automated Time-Stamped Recordings to ensure compliance
Certified Document Uploads for notices, declarations, and payments
Integrated Complaint Portal linked to HUD, CFPB, and DOJ
Audit Trail Required Before Any Foreclosure is Finalized
IV. CONGRESSIONAL ACTION REQUESTED
We, the undersigned, demand that Congress:
Draft and pass legislation establishing the Foreclosure Transparency and Oversight Platform (FTOP) under the Department of Housing and Urban Development (HUD) or the Consumer Financial Protection Bureau (CFPB);
Require all 50 states to participate, regardless of whether their process is judicial or nonjudicial; Provide penalties and sanctions against banks, trustees, and attorneys who bypass or falsify required steps;
Create a federal right of action for homeowners to sue when violations occur;
Guarantee that no foreclosure can proceed unless all steps on the FTOP checklist are completed. Each step will be locked in by mandated timelines. When completed then next step is released. All contact, mailings, postings all requirements will be documented in their timeline and certified.

Wrongful foreclosures are destroying lives, families, and communities. We demand that Congress act now to create transparency, fairness, and accountability in the foreclosure process nationwide. Let this platform be a new era in homeowner protection.
